About The Settlement

1. Why did I receive this payment?

Your settlement payment is the result of a settlement in the Ron’s Staffing Fingerprint Settlement.

The Lawsuit alleged that Ron’s Staffing violated BIPA by collecting fingerprint data from employees in Illinois through its employee timekeeping system without first complying with BIPA’s disclosure and informed written consent requirements and without maintaining a publicly available policy regarding its retention schedule for biometric information.

Ron’s Staffing denied the allegations in the Lawsuit and denies any violation of the law. Ron’s Staffing maintains, among other things, that: the collected data does not fall within BIPA; it obtained consent to collect the data alleged to constitute biometric information; there never was any data breach; employee data was collected and timely deleted in compliance with all legal requirements; it maintained in its facilities and available to employees the disclosures and policies required by BIPA; and there never was any risk of a data breach.

The Court has not decided whether Ron’s Staffing violated BIPA.  Both sides agreed to the settlement to resolve the Lawsuit. The Settlement has been granted final approval by a circuit court in Will County, Illinois.

2. Who received a settlement payment from the settlement?

Eligible class members who timely returned valid claim forms were sent settlement payments.

If you chose to receive your settlement payment by check, please cash your check by July 17, 2023 or it will be void.

If your address changed recently, send an email with your name, your old address and new address to info@RonsFingerscanSettlement.com.

3. How do I get a settlement payment?

To receive a settlement payment, you must be a Settlement Class Member and have completed and submitted a timely and valid Claim Form.

It is too late to submit a Claim Form now.

4. How will I receive my settlement payment?

Eligible class members could select electronic payment or payment by check. If no payment election was made, eligible class members were sent checks in the mail to the address provided in their claim form.

If you elected to receive an electronic payment, and the electronic payment is unsuccessful for any reason, a check will be issued to your mailing address.

Checks will not be issued until the unclaimed funds are received back from the electronic payment processor. It will take more than a month to receive those funds back and issue checks.

5. I need my check reissued. What should I do?

6. Is it too late to receive a settlement payment if I did not timely submit a claim form?

Yes, it is too late. If you did not previously complete and return a claim form by the deadline set by the Court, you are not eligible to receive a settlement payment. No exceptions can be made.
